TROVE MARKETPLACE TERMS OF USE

Welcome to Trove Marketplace (“Trove,” “we,” “us,” or “our”). Trove Marketplace is an inclusive ecommerce platform dedicated to empowering individuals with disabilities through economic opportunities. By accessing or using our website, services, and platform (collectively, “Services”), you agree to be bound by these Terms of Use (“Terms”). Please read these Terms carefully before using the Services. If you do not agree, please do not access or use our Services.
1. Acceptance of Terms
By creating an account, accessing, or using Trove Marketplace, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy. Trove reserves the right to modify these Terms at any time, and we will notify you of any changes by posting the updated Terms on this page and updating the “Last Updated” date. Continued use of the Services after changes are posted constitutes your acceptance of the modified Terms.
2. Eligibility
To ensure eligibility for disability-inclusive programs on Trove Marketplace, sellers will be required to provide details their disability when prompted during the approval process. This information will be used solely for verification and to tailor platform support and accommodation. No additional medical records or certificates will be required beyond this disclosure.
Seller Eligibility:
- Trove Marketplace is exclusively for individuals with disabilities as defined by the Americans with Disabilities Act (ADA).
- Sellers must meet the ADA definition, which includes a physical or mental impairment that substantially limits one or more major life activities
Age Requirement:
- You must be at least 18 years old or have the legal capacity to enter into these Terms. By using our Services, you affirm that you meet these criteria.
Buyer Eligibility:
- Buyers must be at least 18 years of age or have the consent of a legal guardian to use Trove Marketplace.
3. Account Registration
To use certain features of our Services, you may need to create a Trove account. In doing so, you agree to:
- Provide accurate, truthful, and complete information during registration.
- Keep your account information up to date.
- Maintain the security of your account by protecting your password.
- Be responsible for all activities that occur under your account.
4. Seller Terms and Conditions
4.1 Seller Eligibility and Disability Disclosure
- Sellers must truthfully disclose their disability status during registration and may be required to complete the Seller Disability Disclosure Form.
- Trove reserves the right to request additional documentation or verification as necessary.
4.2 Listing and Selling
- Sellers are responsible for accurately listing and describing the products and services they offer.
- Sellers must comply with all applicable laws and Trove’s policies regarding prohibited items and transactions.
- Trove Marketplace reserves the right to remove listings that violate our policies or are deemed inappropriate.
4.3 Fees, Payments, and Shipping Charges
- Sellers agree to pay the applicable transaction fees as outlined in the Seller Membership Agreement. Trove may adjust fees with prior notice.
- Sellers determine and clearly state shipping costs in their listings.
- Sellers are responsible for all shipping charges unless otherwise agreed with the buyer.
- Shipping fees must be accurately reflected in the final purchase price.
- Any agreement regarding buyer-covered shipping costs must be documented via the platform's messaging system.
4.4 Prohibited Transactions
- Sellers must not engage in the sale of illegal, hazardous, or restricted items (e.g., weapons, illegal substances, stolen goods, or items violating intellectual property rights).
- Violation of these policies may result in immediate suspension or termination of seller privileges.
5. Buyer Terms and Conditions
5.1 Buyer Responsibilities
- Buyers must provide accurate information during checkout and read the full product description before making a purchase.
- All purchases are considered final unless otherwise stated by the seller or subject to the seller’s policies.
5.2 Prohibited Buyer Activities
- Buyers may not engage in fraudulent activities, including creating false reviews, using multiple accounts, or attempting to bypass seller fees.
- Buyers must not harass, abuse, or engage in discriminatory behavior towards sellers.
6. Relationship Between Buyers and Sellers
Trove Marketplace serves as a platform connecting buyers and sellers and is not a party to the sales contract between them. All transactions, customer service issues, product inquiries, disputes, and resolutions are strictly between the buyer and the seller. Trove does not offer warranties, guarantees, or refunds for products or services sold on the platform. Sellers are solely responsible for fulfilling orders and handling related issues. By using the Services, both buyers and sellers agree that Trove is not liable for any disputes or damages arising from transactions. Trove reserves the right to facilitate communication between parties butis not obligated to resolve disputes.
7. Use of Services
You agree to use Trove Marketplace in compliance with all applicable laws and respect the rights of others. Specifically, you agree not to:
- Transmit unlawful, offensive, threatening, or defamatory material.
- Impersonate another person or entity.
- Interfere with or disrupt the Services, servers, or networks.
- Engage in activities that compromise the security of the platform (e.g., hacking, phishing).
8. Intellectual Property
All content on Trove Marketplace, including logos, text, images, graphics, and software, is the property of Trove or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works of any content from the Services without express permission.
9. Privacy and Data Security
Your use of Trove Marketplace is governed by our [Privacy Policy], which outlines how we collect, use, and protect your personal information. By using the Services, you agree to the practices described in our Privacy Policy.
10. Limitation of Liability
To the fullest extent permitted by law, Trove will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services. This includes, but is not limited to, loss of profits, data, or goodwill, even if Trove has been advised of the possibility of such damage.
11. Indemnification
You agree to indemnify, defend, and hold harmless Trove, its affiliates, and its respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising from your use of the Services, violation of these Terms, or infringement of any rights of another.
12. Termination
Trove reserves the right to suspend or terminate your access to the Services at any time, with or without cause, and without notice. Upon termination, you must cease all use of the Services. Provisions that are intended to survive termination shall continue to apply.
13. Governing Law
These Terms are governed by the laws of the state in which Trove is headquartered, without regard to conflict of law principles. Any legal actions arising from these Terms must be brought exclusively in the appropriate state or federal courts within that jurisdiction.
14. Dispute Resolution
If a dispute arises, we encourage you to contact us to seek a resolution. However, since Trove is not a party to transactions between buyers and sellers, all transaction-related disputes must be resolved between the buyer and the seller. Trove is not responsible for resolving disputes over refunds, product issues, or service quality.
